A diagnosis of mesothelioma is a very serious matter, but medical advances offer increasing hope for asbestos victims. You will learn more about asbestos in worksites, and the asbestos industry's fifty-year effort to suppress the facts about the lethal effects of this material on workers. For more than a century asbestos was widely used in the United States in industrial applications for its insulating and fireproofing properties. Asbestos diseases including mesothelioma, asbestosis, and lung cancer arise from continuing exposure to airborne microscopic asbestos fibers.

The most common sources of asbestos exposure are work in commercial and domestic construction, especially installing insulation, work in shipyards, and in service aboard naval or commercial ships. Even family members of asbestos workers were often exposed to levels of asbestos sufficient to trigger mesothelioma.Since the 1920's, companies that mined and manufactured asbestos products knew that it presented serious health hazards for their workers. Senior company officers conspired to suppress that information, preventing workers, and even their own managers from knowing the dangers of working with this lethal material. Because of that conspiracy, workers with mesothelioma and other asbestos-caused cancers have important legal rights to compensation from the companies whose negligence and disregard for their safety has harmed them.Asbestos cancers, like mesothelioma, are slow-growing.

Symptoms may first appear as much as 15 to 40 years, or even more, after the initial asbestos exposure.By the time a mesothelioma diagnosis is established the disease may have progressed so far that the victim may not have much time left. Once a mesothelioma diagnosis is established, it is critical to move rapidly to file a mesothelioma or asbestos litigation claim, and press for a timely resolution. If you or a loved one has mesothelioma or another asbestos-caused disease, it is vital to secure an asbestos attorney who is experienced and knowledgeable in asbestos litigation. The plaintiff’s citizenship or immigration status is not an issue in cases involving asbestos.

To understand how to choose a lawyer for this disease, you should first understand the basics of the disease. In the simplest sense, mesothelioma is a cancer of the protective layers of the body cavities, known as the mesothelium. These tissues have different names depending on the organs they protect. You have probably heard of the peritoneum–this is the covering around the stomach and intestines.

Other organs and cavities have their own membranes as well.Mesothelioma is a cancer of these tissues. They often do not just affect the tissues–they affect the organs they surround and can spread elsewhere. This cancer is most often contracted by exposure to asbestos, a highly dangerous mineral often found in floors, ceilings, and some products.

Employers and landlords are supposed to protect you from asbestos, but often this does not happen. If you have mesothelioma you have probably been exposed to asbestos. If so, you should contact mesotheloma attorneys in your area to see if you have a case against the party responsible for your exposure. How Do I Choose?San Diego is a big place.

Choosing a professional in this area is a daunting task for busy people, so here are some steps to take to make the process easier.Mesolthelioma lawyers get to know the doctors who treat the disease. Over time they develop relationships and form help networks for patients. Often a doctor will have several contacts in the legal field and a lawyer will have several contacts in the medical field.

This helps save you time.If you have been diagnosed with mesothelioma, your oncologist may be your best source of names for attorney contacts. She will likely have already worked with them on cases and can tell you not only who specializes in your type of cancer but who is best and who is within a short distance from your home or work. If you do not request a hearing within the fifteen (15) day time period your driver’s license will be suspended on the fortieth (40th) day following your arrest.

DWI FACT: You have the right to remain silent and not answer any questions. You should never answer the officer’s questions regarding your impairment or the amount you had to drink.

DWI FACT: The Intoxilyzer machine is a large machine and is housed at the police station. If the officer pulls out a handheld device, commonly referred to as a “Portable Breath Test” device or “PBT”, you are not required to blow in the device nor will your driver’s license be suspended for refusing to blow into the device. In fact, in Texas, the actual results of this test are not admissible in Court at your trial.

DWI FACT: In Texas the sampling of blood, breath and urine are the three ways law enforcement officers measure the alcohol content in an individual’s body. In most situations you do not have to submit to any of these tests, unless you are under a direct court order.
DWI FACT: If you are interviewing an attorney about your DWI case and the attorney does not mention or discuss representing you at the Administrative License Revocation (ALR) Hearing as part of his or her representation of you in the DWI case then you are not talking with an experienced DWI lawyer.

DWI FACT: If you plead guilty you will be giving up many important rights. Do not do it unless directly advised to do so by a lawyer representing you and your best interests.
Driving While Intoxicated or “DWI” is a very serious offense in Texas. The individual arrested today in Texas for Driving While Intoxicated, commonly referred to as DWI, faces bewildering procedures and potentially devastating punishments, i.e., suspension of driving privileges, fines, and/or jail, or prison if there are injuries, particularly if this is not that person’s first time being charged with Driving While Intoxicated as well as surcharges and devastating administrative fees. Sometimes the punishments can be more severe than some felony offenses not to mention employment opportunities destroyed as well as automobile insurance costs soaring through the roof. You should remember, DWI is the only criminal offense that uses subjective evidence for convictions — i.e., the evidence against an individual is based on the personal belief of the arresting police officer for the few minutes they are around each other.

If you or someone you know is charged with Driving While Intoxicated, the case should be discussed with an attorney who handles DWIs as opposed to someone who has handled a few or whose work is mainly some other area of the law. An attorney can discuss the specific facts of the arrest, and review the evidence that the prosecutors will rely upon at trial. In many cases, there are valid legal defenses available to these charges, and an attorney experienced in handling DWI cases is best prepared to present these defenses to the court. Contrary to popular belief, some experts as well as this author believe that both the breath machines (Intoxilyzer 5000) as well as the field sobriety tests administered by police in Driving While Intoxicated (DWI-DUI) cases are inaccurate and unreliable.

This website is designed to give you information and an overview of Driving While Intoxicated (DWI) law in Texas. Do not rely on it for legal advice, as it is not intended to help you represent yourself in your own DWI case. Neither will this website tell you how to “get off” of a DWI in the future. Please remember, every case is different depending on the facts. Be sure to consult a lawyer for your specific case.

Accident lawyers from the Chicago law firm also represented a critically injured victim in an explosive power plant fire in Indiana. Lawyers at the personal injury firm also represented those involved in a gas explosion at a suburban home. There are different degrees of fault and several elements are necessary to prove in court, in order to be successful against the wrongdoer in a tort action. Clifford Law Offices determines if the accident or injury is potentially recoverable in a court of law. Consulting one of our experienced Clifford Chicago personal injury lawyers will provide a sound basis on whether to pursue an action in court.

In other Illinois personal injury actions, Clifford Law Offices represented Rob Komosa, a teenager who was tackled into a goal post and then tragically became a quadriplegic. The high school field where it happened has since moved the goal post further from the field and has added padding to the steel post. Rob has bravely gone on to try to help other quadriplegics. Also, Robert Clifford received a $14.2 million verdict for an 11-year-old Boy Scout who was injured while on an outing in a forest preserve, as reported in the Chicago Sun-Times. Mr. Clifford also was awarded a record amount for a 21-year-old swimmer who was rendered a paraplegic when he broke his neck in a diving accident, according to the Chicago press. Robert Clifford also received a $29.6 million verdict following a month-long trial on behalf of Rachel Barton, an internationally-acclaimed violinist who was severely injured in a commuter train accident. Mesothelioma Lawyers San Diego

Mesothelioma Lawyers San Diego
Our San Diego mesothelioma lawyers and asbestos attorneys have created this site especially for people who have been diagnosed with mesothelioma and other diseases caused by asbestos exposure. You and your family will find information about causes of asbestos disease, and about diagnosis, treatment, and the latest medical research and also about national organizations to help patients and families dealing with mesothelioma.

Even family members of asbestos workers were often exposed to levels of asbestos sufficient to trigger mesothelioma.

Since the 1920's, companies that mined and manufactured asbestos products knew that it presented serious health hazards for their workers. Senior company officers conspired to suppress that information, preventing workers, and even their own managers from knowing the dangers of working with this lethal material. Because of that conspiracy, workers with mesothelioma and other asbestos-caused cancers have important legal rights to compensation from the companies whose negligence and disregard for their safety has harmed them.
Asbestos cancers, like mesothelioma, are slow-growing. Symptoms may first appear as much as 15 to 40 years, or even more, after the initial asbestos exposure.

By the time a mesothelioma diagnosis is established the disease may have progressed so far that the victim may not have much time left.
Casey Gerry has represented Mexican citizens, Mexican nationals living in the US, and undocumented immigrants who have been harmed by asbestos. If the harm was due to unsafe materials and/or workplace practices on the part of a US manufacturer, Casey Gerry asbestos attorneys can pursue redress in US courts.

San Diego mesothelioma lawyer Frederick Schenk is a senior partner at Casey Gerry, the oldest personal injury law firm in San Diego, and he has practiced asbestos law and mesothelioma law for more than 24 years. Casey Gerry has advocated for injured workers and their families since 1947, and is nationally known as a leading advocate for victims of mesothelioma, an asbestos-caused disease. In 1996 Mr Schenk won the largest verdict ever awarded in an asbestos lawsuit in the County of San Diego. He was selected by San Diego Magazine as the best asbestos attorney in San Diego, and the Consumer Attorneys of San Diego voted him the Outstanding Trial Lawyer for that asbestos personal injury verdict. The San Diego Daily Transcript ranked him as one of the Top 10 lawyers in San Diego in 2005, and he is listed in Woodward and White's prestigious Best Lawyers in America.

Frederick Schenk works closely with a team of practiced mesothelioma lawyers, asbestos attorneys, and paralegals. Casey Gerry paralegals, some of whom have worked more than 20 years helping victims with asbestos claims and mesothelioma lawsuits, know how to obtain the essential documents that identify where and how the disease-causing exposures occurred. They work closely with Mr Schenk's asbestos clients and their families throughout the litigation and claims process.

Frederick Schenk and the Casey Gerry asbestos and mesothelioma legal team have helped thousands of people through the claims process and the trial process, to obtain substantial compensation for their clients from the companies that manufactured, installed and sold asbestos products throughout the United States. If you or a loved one has received a diagnosis of mesothelioma or other asbestos-caused cancer, it is critically important to act quickly, so that vital information regarding asbestos exposure and medical care are secured.

San Diego mesothelioma lawyer Frederick Schenk and his staff at Casey Gerry are dedicated professionals with decades of experience who can take prompt and effective steps to help you and your family through all aspects of the asbestos law, and mesothelioma litigation claims process.

LAW

Law[4] is a system of rules, usually enforced through a set of institutions.[5] It shapes politics, economics and society in numerous ways and serves as a primary social mediator of relations between people. Contract law regulates everything from buying a bus ticket to trading on derivatives markets. Property law defines rights and obligations related to the transfer and title of personal (often referred to as chattel) and real property. Trust law applies to assets held for investment and financial security, while tort law allows claims for compensation if a person's rights or property are harmed.

If the harm is criminalised in a statute, criminal law offers means by which the state can prosecute the perpetrator. Constitutional law provides a framework for the creation of law, the protection of human rights and the election of political representatives. Administrative law is used to review the decisions of government agencies, while international law governs affairs between sovereign nation states in activities ranging from trade to environmental regulation or military action. Writing in 350 BC, the Greek philosopher Aristotle declared, "The rule of law is better than the rule of any individual."[6]

Legal systems elaborate rights and responsibilities in a variety of ways. A general distinction can be made between civil law jurisdictions, which codify their laws, and common law systems, where judge made law is not consolidated. In some countries, religion still informs the law. Law provides a rich source of scholarly inquiry, into legal history, philosophy, economic analysis or sociology. Law also raises important and complex issues concerning equality, fairness and justice. "In its majestic equality", said the author Anatole France in 1894, "the law forbids rich and poor alike to sleep under bridges, beg in the streets and steal loaves of bread.

"[7] In a typical democracy, the central institutions for interpreting and creating law are the three main branches of government, namely an impartial judiciary, a democratic legislature, and an accountable executive. To implement and enforce the law and provide services to the public, a government's bureaucracy, the military and police are vital. While all these organs of the state are creatures created and bound by law, an independent legal profession and a vibrant civil society inform and support their progress.
